What to do company is sending notices to recover notice period amount
19-Jun-2023 (In Labour & Service Law)
I received a letter from Company to recover notice period amount of rs42867 and giving a legal action warning against me. I worked only 6days there and I'm on probation period on that time. Still I'm jobless and don't have money to pay this amount.
If you joined company you are bound by terms of contract If the terms state that you were required to pay for notice period or you were to work there diring notice period then you have to pay There is nothing which can be done However if terms did not specify payment you can write back to company
You should reply back to this legal notice received by you and shall refute all the claims which they are making against you.
You should also file a caveat before the court where the jurisdiction lies so that your company couldn't get case admitted against you and you can get it canceled at the time of admission only.
