What can be done if boss issues false show cause and warnings

08-Jan-2023 (In Labour & Service Law)
I've been working in this organization for 12 years and have been doing very well. I earned a promotion and my performance speaks very well of my dedication. But my new boss has made my life hell by issuing showcauses and warnings for 3 years prior to which I received none for 9 years. What do I do?

The harassment mentioned by you in your query is seemingly becoming a problem being faced by many employees of late and the trend seems to be increasing by the day.

Under most circumstances, the Performance appraisals are done by the immediate bosses but approved by the higher authority above the immediate boss. The concerned official can obtain the performance appraisal report by moving application under the Right to Information Act.

After obtaining your performance Appraisal report / CR, if you have grievance then send your complaint through proper channel to the Higher Authority (in most cases via the HRD).

If your grievance is not redressed, then you can move the concerned Labor / Civil Court for relief based on your designation and work profile.

You need to see your appointment letter and service rules. In case enquiry is permissible, Draft a strong reply and suit the same with supporting documents.

Make sure you're legally acquainted with facts. You should know what not to write.
