Recently joined a company. Company has harassing me a lot. I have an offer from another company and i wish to join that. As per the contract there is 2 month notice period which i do not wish to serve. I can pay for that. What if the company does not allow me to leave neither provide my experience letter. Private employment is governed by the employment contract. Generally there is a buyout clause, in which you can make payment for the notice period, there after the company is obligated to provide you the experience letter and relieving letter.
If the company fails in providing so, then you can send a legal notice through an advocate asking for the same and if the company fails to do so then you can file a civil suit for the same.
