Termination from Service. Pension and PF not given till pending case.

My Father was in MPEB(Madhya Pradesh Electricity Board) & he was terminated in 2009 ,close to his retirement dates, due to fraud marksheet case. We filed the case in 2009 , and decision is pending with Gwalior High Court, he served his entire life and being promoted during his tenure, he only received his gratuity, but Pension and PF clearance is being held till the decision . I would like to know the possibilities of winning the case or avoiding the punishment as he is old and not keeping well. Please advise .
