Statutory Liability cheques got bounced after Resignation

I have given resignation from the post of Sr.Accountant last year and received the full and final settlement amount but the company has bounced the cheques for some statutary liabilities of that period. Is it any liabilities after resiganation. pls inform

yes u have.the liablity to take the money back because some of your cheques have been bounced you have the write to take the money from the company because cheque bounce is a serouis offence so you can take the money back

Dear Client, you should immediately get a legal notice sent under Section 138 of the Negotiable Instruments Act through advocate. Basically you need to get this notice sent within 30 days of the bouncing of cheque, thereafter the Accused has 15 days to pay, if he fails to pay you have further 30 days to file a complaint under Section 138 before the magistrate.

Cheque bounce attracts criminal liability once it is proved that it was issued lawfully then the issuer is liable to pay double amount and can be jailed as well. First of all after the cheque was bounced give a legal notice and then file the case under section 138 Negotiable Instruments Act. The case has to be filed within one month of legal notice period.

Hi, will glad to help you. You need to file a case for cheque bouncing against your company under 138 of the Negotiable Instrument Act,1881. Eventually he has to pay as it is a criminal offence under India law.

Your query is not clear. Please give clarity as to chequers issued by whom has bounced.as per my understanding the cheque issued by the company in your name in lieu of the settlement has bounced, implying that the cheque they issued to you has been dishonoured and therefore you may initiate proceedings under section 138 of the negotiable instruments act, irrespective of your resignation.
