Solicitation of Customers and Employees of ex-employer
12-Oct-2023 (In Labour & Service Law)
I work in IT industry. I was working with an organisation for a long time. I left them and started a new organisation. As part of the separation, they wanted me to sign a document which had contained a clause stating I cannot indulge in any “solicitation of their customers and employees”. I found that there is no time duration mentioned for this non-solicitation (some friends told that they normally have this clause for 6 months or so but cannot be indefinite). To my surprise, some customers now want to us with my new company. In addition, some of my ex-colleagues also are keen to join my start-up. Do let us know how to handle this situation to avoid any legal issues as I have signed the document.
Dear Sir,
Yes there is a time period in which you cannot solicit your ex- employers customers or employees. kindly speak to them and get a new agreement which mentions the time limit as well. if you have signed it then kindly take initiative to go and ask about the time duration if not then kindly get the time period mentioned.
