04-Aug-2023 (In Labour & Service Law)
Presently I am working in a firm where I have signed a bond for 2 years and given a postdated cheque of Rs 4 Lacs on 1st Jul, 2017 which was part of agreement. I have joined in 9th April, 2017. I am very frustrated with work environment and want to quit. Please guide me how to proceed with the same. Thanks
in this case you can state your concerns to the higher authorities of the company in the form of a letter. However you can also send them a legal notice stating your demands and concerns. You can also file a civil suit for the recovery of your money under the provisions of civil procedure code .
If the company has not given you any sort of training (either internal or external) which may assist you in any way in your job then better file a suit for that challenging the bond which you have signed with the company. That is the only way to come out of the company without paying the sum of the bond.
But if they have given you any sort of training then you have to pay the bond amount though you can minimize the cost of bond amount by contesting it in the same manner as stated above but cannot negate it altogether.
