Service bond transfer issue in Punjab National Bank

11-Apr-2023 (In Labour & Service Law)
I am currently employed in Punjab National Bank as Manager and have been selected in Bihar State Govt. Job. I have applied through proper channel and there is a service bond of Rs. 3Lacs in PNB. nAs per DPE office memorandum no. 15(2)/2003-DPE(GM)/GL-57 dated 29.07.2004, if an employee leave the services of one Govt. / Public sector enterprise to join Central Govt./State Govt. services, a fresh bond should be taken from the person concerned to serve the new employer for the balance of the bond period and no service bond should be enforced. nnThe above mentioned O.M. of DPE has also been reinforced by Ministry of Finance in its O.M. No. 20/53/15(2)/2009-IR dated 05.10.2009However, PNB has denied my request of transfer of service bond and has asked to pay Rs. 3 lacs. My last day at work is 31.05.2022. I want to know that if i file a writ petition in court against PNB, how much time will it take for a court order directing PNB to transfer my service bondThanks in advance.

Since your last day is near considering the urgency the matter may get expedition disposal. However we first require to take stay over any coercive action by the state against your change in service and then press upon the merits for serving of bond. Atleast you get to join the new department. For any further legal assistance please feel free to contact.

We will have to make a thorough study of your case and file a writ petition in Delhi high court for the desired relief. moreover if we file writ in high court we can get stay till the proceedings are over. so it is better that we file writ as soon as possible.

Hi. Yes a writ petition can be filed and it needs to be done immediately so that it's urgently heard and relief is granted to you in the first hearing itself. Otherwise it will take months/years for final decision and that will not help your case. Please contact for a more detailed discussion.
