Seeking Legal Advice for Employment Rights and Unfair Compensation

01-Oct-2024 (In Labour & Service Law)
I completed my 6-month probation in July, but my company has withheld my full-time appointment letter due to a delay in providing my 8th-semester marksheet. Despite working full-time hours and duties, I'm still paid an intern’s salary. Requests for a salary increase or appraisal have been delayed or denied, and the company refuses to issue an experience letter until the appointment letter is provided. I seek legal advice on how to address this unfair treatment.

You are entitled to be treated as a full-time employee after completing your probation period, irrespective of any delay in submitting your marksheet, as long as your work hours and duties align with full-time employment. You may approach the appropriate labor court or authority to file a complaint for non-payment of fair wages and wrongful withholding of your appointment letter. You could also demand your experience letter through a legal notice, emphasizing your actual work and responsibilities. Additionally, non-compliance with labor laws regarding pay may strengthen your case. Initially you can send them a legal stating your legal standing. For more you can contact me.
