Salary Deducted in the name of retention bonus

27-Aug-2023 (In Labour & Service Law)
Hi I have a concern I had been working for a corporate company and they used to deduct 4100 from my salary which was a part of my CTC in the name of retention bonus. Is that a law in India. As I had worked and it was told to me after 3 years you will get it back but this company had asked me to leave with no notice. Please suggest.

Hi,
Your query do not discloses important details and informations such as year/date of joining, date of termination, was there any instance of misconduct.
Was there any termination letter given to you? If not were you forced to give resignation letter before leaving?

Please provide the full information only then proper opinion can be rendered.

Please take note -
1. Retention bonus stands for such bonus which will be paid over to your regular salary after completion of certain time period in an organization. If your organization claims this money to be retention bonus then that claim is wrong.
2. The money which has been deducted from your salary is such amount which has been withhold by the company and was supposed to be given at certain time period. If this understanding is not on paper then what they have done is illegal in the eyes of law.
3. If the same is on paper and you have been removed from your job then the company is bound to pay that sum which they have deducted from your account by far now. Your money was supposed to be kept with themselves only in case you would have resigned from your post.
4. If your company gives those deducted amount then good enough else file a case against them and get what is legally yours.
