Rights of workers in unregulated construction sector

The husband of my maid is a daily wager who fell from the roof while constructing a house. He suffered several fractures and incurred huge medical expenditure. Now they want to claim atleast 50% of their medical expenditure from the owner of the house. Under which provision of law can they do so?

If the labour was injured while performing his duty for which he was appointed to do, then as per the Labour Law the employer is liable pay compensation for such medical expenses that has been incurred.
