25-Mar-2023 (In Labour & Service Law)
I Joined on 21-Jan-19 and as per company policy I am under probation period for 3 months
Even though as per Notice 2 months to be given when resigned
As I resigned on March 9th 2019 and mentioned to release by 9th April 2019 but now company asking me to stay till complete some task and then can leave where I cant stay till that date.So if Want to leave it before they r threatening orally we will take action on you.
So please advise what to do
Hi if you have already resigned and you have the documentary proof about submission of your resignation either through mail or acknowledgment of the Resignation Letter then the company can hold you only till the completion of stipulated notice period as mentioned in your appointment letter. They have no legal right to extend your notice period by substantiating the pending work beyond notice period. Such actions by the employer is illegal and you can take legal action on them. You may either approach the Office of the Labour Commissioner or consult an advocate for legal help. Let me know if you need any further assistance in this regard.
