Remedies for breaking the company bond
18-Aug-2023 (In Labour & Service Law)
Hello Sir, I am fresher and signed job bond with one of the startup. Bond is like i won't get any salary for 6 months then will get 12-15K and will get 4 to 5LPA salary if i get deployed to client location they will show my fake experience to client. Bond amount is 350000 rs on 100rs stampaper. But by seeing current situation i have been here since 4 months and not getting any salary as well as no client interviews. As while joining they told we will give you client interviews within 2-3 months now they are saying it will take time for you to get deployed at client and my current location is Noida. Here i don't know when i will get deployed or not. And now i got job in other company with salary and proper work so can i break the bond and join this company in Hyderabad. Please sir kindly let me know what will happen if i break.
he has all the rights to sue you. As you have violated the terms of agreement so he can file the case in the civil procedure code as well as contract act can also be invoked here. As per the recent development in law made by the Supreme Court and various High Courts, such bonds are lopsided and are not legal and enforceable under law.
Nobody could enter into a bond/Agreement with you in restraint of your trade and profession. In any case, such Agreements are not backed by law, when this bond amount was not spent in entirety by your co. on you by way of providing you training etc. You free to break free from the shackles and join the new Co.
