releving letter from previous company

Hi i have resigned my job and i have submitted my resignation letter to HR.as per the company rules notice period is 60 days(2 months) somehow i have managed and worked for 40 days. due to my family issues i couldn't able to continue my notice period after that.ow the notice period days has been passed on. i am in need of relieving letter to apply for future.Once i approached my HR for relieving letter. he is insisting me to serve the balance 20 days even though i accepted to pay penalty for those 20 days..But practically i cannot do that. How come can i get the reveling letter.

Hi, none has the right to force against the will of an individual and it amounts to violating the personal liberty of an individual. As you have served the notice period in half and the remaining will have to adjusted towards recovery of the dues payable against shortfall of notice. Approach the top most officers of the Company on both letter and mails to seek help and release of relieving letters. If there is no response, then consult an advocate to send a legal notice to Company to adhere to the guidelines under law and not to violate it if not the legal course of action may be initiated.
