Can a Terminated Employee get education in period of Termination. He can claim 100% back wages for that (Education Period) Period.
There is no bar to getting education at any time including the period of termination. However to claim a hundred per cent back wages on reinstatement you have to show that you were not gainfully employed anywhere in that time period. Although getting education might not necessarily fit in the term gainful employment but the fact that you were gainfully occupied might be taken into consideration by the Court. It would thus be question best left for the Courts to decide in the peculiar facts of your case. If not back wages you could be awarded compensation.
