Regarding regularization on the post

19-Aug-2023 (In Labour & Service Law)
Sir, I have been working as an Assistant Professor on Contractual basis in a Govt. Engineering Institution in Uttar Pradesh for more than last 10 years. Now the Institution has released an advertisement against the post on which I have already working. In this connection I would like to know whether I must apply for the same post or go to the Court for getting stayed for holding the interview.

Good evening. You can surely approach the high court for regularisation of your services considering the fact that you have worked for more than 10 years or 10 years at the particular post in the said Government education institution. It is very pertinent to mention here that the supposed action you are to take in this regard has to be as soon as possible and not after the final interviews for the said post have been initiated/conducted. The faster you move in this regard the easier and the better it is in terms of success rate and better chances for you in terms of getting your services regularized. I would recommend that before making any kind of Representation or making any sort of application for the new post you should meet with me, get all the facts and circumstances in your particular case on the table before taking any step which might turn out to be adverse in future. Another aspect that should be kept in mind at the stages that you have already work through your services and that you have the authority of being or rather you have the standing of being appointed as a regularised professor or regularised employee if I were to say in so many words.
Please feel free to share further details.

hi,
you should go to the court and get the advertisement stayed because the law is settled in this connection that they should consider you first for regularisation before advertising.
