Regarding Non payment of my dues after resignation

I lived in New Delhi and i Worked in gurgram based startup. Now resigned from my company But they are not giving my Dues in 45 days of relieving date as per policy of my company They said we give salary in parts payment because company condition is not good. But another employee of my company relieved from my company before 8 month age he also not get their dues till now. So please suggest me what option i choose take a legel action against company to give my dues in 45 days of my relieving day or get in payment in parts after 45 days.
yes you need to take legal action for payment of arrears of salary before relieving period. according to the nature of your company u can file case in appropriate concerned court. since it is the policy norms of the company it has to abide by it. and taking it's own in capabilities as defence the company cannot run away from its liability towards it employees
