Regarding my service related issues what to do

haMyself a serving railway employee,a sectional incharge in railways of group C category.previosly i have been imposed penalty of stopping of 3 years increment due to my trade union activity.but as per 1926 trade union act i have the wright to be a union member.can i proceed against the railway administration? Another matter is a promotion order has been issued by our division in which it is stated if i am transferred then only i will get promotion.otherwise not.but promotion is on seniority basis.then how administration can impose this type of clause?pls suggest me

You see the promotional order itself is based on arbitrary ground and service rules. Therefore is always subjected to challenges before the CAT. Apart no one can barred you from enrolling in any Trade Union, but please do not participate in the activity at the state of your job i.e. while on duty as your employer can hold you responsible for not working while at job and can even initiate disciplinary action.
Please send a legal notice to your personnel department on the matter of this promotional order and request them for your promotional review.
