Regarding harrasment from an unrecognized Labour Union

I am running a business with approx 30 employees. 2 months back about 20 of them quit suddenly to work for a competitor, most didnt provide termination notice or serve the mandatory resignation period. In response to this we withheld their gratuity payment while we run an audit on possible theft of internal data. They have approached an unknown labour union & this union has sent us a letter, they call our offices everyday, visit the offices, & even turned up at our personal residence. The police is hesitant to file a harassment case. Please note this is the first time we have heard of the is union, the ex employees were not part of any union while they were working for us. The letter the union sent us has a number preceded by "Registered ALC". We would like to know a legal recourse to stand up to the harassment faced from this "union". We would also like to know how to check their registered ALC number to know whether this is even valid or not.

My Response to your query :

1) you can reply to notice received by you
2) after that you can launch complain against that person and union
3) you have rights to protect your record
4) your partners allredy lost all rights in your company
5) you can take criminal action also

You need not go to them when you are called as it's not binding upon you to respond to them. As far as harassment is concerned, you'll have to give a writing complaint to police and if police don't take action then you'll have to file complaint before SP. If he too doesn't respond positively then you can approach court for criminal proceedings against them.

This is my response to you:
1. You will need to sit with the union leader and negotiate;
2. Try to mediate the problem with a mediator (preferably a lawyer) present;
3. Send them a legal notice for absconding etc.;
4. If they continue to harass you then you will have to approach the labour court and file a formal complaint.
