Query regarding Promotion is not given

Dear sir My case pertains to promotion.I am working in Govt. Org.The CGIT-2 Mumbai has given an "order"in my favour in May-2017. However my employer is not implementing the order. I have submitted an application to the court for taking necessary action against the employer for non implementation of the order. I am due for retirement in a few months and I do not wish to continue the case further. I want to know: 1.Can I withdraw the case now. 2.What will happen if I withdraw the case now . 3.What is the procedure. Thanks in advance S.Vasudevan 23.9.2018

Dear Client,

Your query is in very brief and you have not give the details of your case and order of promotion. Your organisation must honour the order of the court or they may go for appeal against the said order . Hence, they may not implement the order .

My Response to your query:

1) you can withdraw the case.
2) If you withdraw the case you will not able to gent the benefit of promotion and pay scale of promoted post.
3) to answer your question information provided by you is insufficient where you have filed complain and where your matter is pending. in come court oral statement is sufficient, if you are party respondent you have to place application on record . if you have already engage and lawyer you can send letter to your lawyer.

This is my response to you:
1. You can withdraw the case;
2. But it is better that you wait till retirement;
3. Let the court also see how long your employer protracted the case;
4. The court may award you with compensation for the loss of pay suffered by you;
5. So let your case continue;
6. Consult a local lawyer and then only take steps after discussion of whole facts.
