Query pertaining to Unpaid salary & Gratuity

Dear Sir / Madam, I was working for a construction company for last 5 years and parted ways with them in March this year as company was not able to pay salaries on time and delay was close to 2-3 months. My current dues with the company is as follows : * Salary for Last quarter ( Jan to March) * Gratuity for last 5 years. its been more then 5 months now but company has still not cleared my dues. They were also not issuing Form 16 and provided the same on last day of return Filing. To my shock, when I checked my Form16 and 26AS, my employer has shown that dues are paid and TDS is not deducted. I spoke to HR and he said that its because we will clear the dues in a months time and the From 16 and 26AS can be revised. Please let me know if I can trust the HR and if not then what are my legal options . Thank you.
For this you need to go through the policy of that particular company. . Further if they do not reply you can send them a legal notice atating your demands and recovery of the salary money which is due with the company. As the last option you can also file a recovery suit against them under the provisions of Civil Procedure code.
