Procedure to obtain the salary from a startup company
19-Oct-2023 (In Labour & Service Law)
I joined a startup on 1st Sep & 3rd Sep the founder criticising and yelling about work.. They took sign on offer letter(it also says in it that offer letter is not a proof of me being employee) and didn't provide my copy. They work was given irrelevant to my profile and I worked 16-18 hours a day to match deadlines.. constant criticizing and stress was unbearable , I had to get admitted the following week..I worked 20 days and when I returned they fired me. I followed up on the salary they said they want to give new offer letter with different package.. after 20 days of follow up..i have been constantly humiliated on calls. On last call the founder was screaming and disconnted when asked for salary. As I don't have any documents.. I m helpless now.. Any suggestions would steps can be taken against this ?? Highly appreciate your time.
If an employer doesn’t pay up your salary, you can approach the labour commissioner. They will help you to reconcile this matter and if no solution is reached labour commissioner will hand over this matter to the court whereby a case against your employer may be pursued. Also, An employee can file a suit under Section 33(c) of Industrial Dispute Act, 1947 recovery of money due from an employer.
