Previous software team is trying to steal my intellectual property
25-Mar-2023 (In Labour & Service Law)
Hello, a previous Indian company that used to do dev work for my startup is attempting to replicate it in a new project. I know this due to a tracking software I implemented into the platform they were not aware of. I can see all tests they do in their local environment including them using their name and login info and attempting to change the name of my product to something different.
We also detailed in our contract that all IP and works belongs to our company.
We are a US company and they are located about 5 hours outside of Delhi.
1- What are our legal options to stop this?
2- How much would it cost to take them to court?
If there are infringing your IP rights in manner then you can certainly file a suit against them for infringement, passing off and permanent injunction in the court of law and you can also claim damages for the same. But I would request you to provide more elaborate details about the same in order to give you better advice with regard to the issue stated above.
