Previous Employer not released my F&F/Pending Salary
22-Aug-2024 (In Labour & Service Law)
My last employer is not releasing my F&F since 80 days stating that they have financial crunches. They are not providing any clarity on the timeline for the payment as well.
You need to send a legal notice to the previous employer stating the that if they fail to release your Salary and F&F Offer they might face legal actions against then. Generally the companies after receiving legal notice release the F&F, if in the case they fail to do so after this stage too, then we can approach the appropriate Court seeking Orders.
If your employer isn't settling your dues despite multiple follow-ups, send a formal reminder in writing. If that doesn’t work, file a complaint with the local labor commissioner, as employers must settle dues within 45 days under the Payment of Wages Act. The labor commissioner can mediate and help you get your payment. If needed, you can also consider legal action for recovery and compensation, but usually, labor authority involvement speeds things up.
