Phone call recordings without my consent what legal action can I take

27-Jul-2023 (In Labour & Service Law)
I am working in Delhi. I have talked over the phone in official matter with an employee and had arguments for using unwanted words and behaviour of the employee towards me. The person on the other side recorded my call without my knowledge and even did not inform after ending the call. Later the recording was circulated in mail to seniors without keeping cc to prove me wrong. I would like to know what legal actions can be taken under such circumstances and what are the acts applicable as I am also afraid now for my personal security in danger as this can be use for wrong way.

You can file a defamation suit against the call recorder and for defaming you in public with an intention to malign your reputation and character. You can also bring up a case against him under the breach of privacy but that would be a weak case as over here a professional call of yours have been recorded and thereafter circulated in among peers.

You have been tricked by the employee Recording of conversation, which was confidential and then circulating it through electronic means is a serious breach of security and an iffence under Information Technology Act
It also amounts to criminal and civil defamation.
You may consult a lawyer, lodge an FIR and institute defamation proceedings against the employee.

Dear Sir

I can understand the issue you are facing and the situation you are in. If the recording was transferred to another device before being circulated then it has no evidentiary value. Also, I will need further details about the extent to which unwanted words were used. If the other employee also used foul language and retaliated back then the blame is less on you. Nevertheless, I would suggest you take preemptive action and file a complaint with the local police authorities alerting them to this incidence. We will be happy to help you in this and discuss this further with you. Our firm has established connections with local police authorities and can help you in all matters.

Please feel free to get in touch with us.

Thanks

Sanjeet
