Partial salary sent based on percentage of work done.
23-Oct-2024 (In Labour & Service Law)
They saying I have left the work unfinished but I completed all the work assigned. They delayed salary for bank issue and now taking advantage of that delay and sent me partial salary based on percentage of work done idk how they calculated it. 57% of salary that is 7000 of 11000. Also they saying my behaviour was not acceptable when I asked for my salary and argued on this and included a friend to call them and ask why they are not paying as I was on probation and a fresher.
In this situation, you can take legal steps to recover your full salary. First, send a legal notice to the employer demanding the outstanding salary. Under the Payment of Wages Act, 1936, an employee is entitled to timely and full payment of wages, and arbitrary deductions or partial payments are illegal. Since you were on probation, ensure that there are no clauses in your contract justifying the deductions or delays. If the employer fails to comply after the legal notice, file a complaint with the Labour Commissioner for unpaid wages, or approach the Small Causes Court to recover the salary. You can also claim compensation for mental harassment caused by their unreasonable behavior.
Well, if they are not paying your the Salary which is your due right, as you were working for them with sincerity and honesty, I urge you, to do not stoop to a low level, as your Ex- Employer is not giving you your Salary again and again, as it has no intention and if you ask again and again for Salary, it'll look like Begging, rather than pleading or Begging, file a Civil Suit against your Employer to recover your Outstanding salaries with Interest.
