Not Paying Salary after Resignation

14-Apr-2023 (In Labour & Service Law)
Case Example: I had Resigned from my Company on 12th March 2021 and requested them to Releive my of my duties by 30th March 2021. In my Appointment letter they have mentioned 3 Months of Notice Period. They have not replied to my official Resignation Email whether they have accepted or rejected my request of Relieving me by 30th March 2021, hence I Continued to come to office. Today is 14th April and they still haven't given me my March month salary inspite of coming to office and working for the entire month of March and 14 days in April All my negotiation and talks have failed, Kindly let me know the Legal route to pursue this.

Hello,
Greetings for the day.
After carefully examining your query we would advise you to consult us with the copy of your appointment letter. Assuming your notice period is of 1 month and Since you have already served than no employer can force you to continue. It is a deemed relieving of the service.

I would advice you to serve your company with a legal notice claiming your salary, if the company still doesn’t give reply to legal notice or doesn’t pay your salary, further recourse of filing of complaint with the labour commissioner or civil suit(depending upon your salary) will be taken.
