Not getting acceptance of resignation from government department

I am working with delhi govt in a permanent job but in probation period. I tender my technical resignation from the present post to join in a job under central govt three and half months back.. I need to give one month prior notice under rule 5 (1) of CCS ( temporary service) rules, 1965 as mentioned in my offer letter. I applied for the post through proper channel. The last date of joining in new job was in January but till now I have not got acceptance letter from authority. Whether I can leave the present job just like that or I need to wait for relieving order.

This is a standard service matter, which often affects government employees when they consider switching engagements between state and central government. Under the proper course you would need a relieving order, since you have bound yourself under the terms of the employment and have technically crossed the stage of probation - thus there is conversion to permanent position. You should file a petition with either CAT or a writ in the High Court.

you should send another reminder to decide on your resignation and benefits, if any payable to you. You should also demand relieving letter and NOC. you also need to complete all documentation pertaining to carry forward of your GPF and other benefits. You cannot quit the job in the absence of all the approvals.
