Non compete agreement clause in Offer letter of current employer.

07-May-2023 (In Labour & Service Law)
I am working for my current company XYZ. Can I join my immediate clients and work for them even if the current companies offer letter has a non-compete clause stating I can't join any competitor/client for a period of 6 months. If in case the competitor is itself giving an opportunity to me what can I do?

Companies may insert non-compete clauses in order to safeguard their privacy, confidential information and know-how from being disclosed by employee to outsiders. It is meant to protect the company's interest. The clause is legal but it cannot be unreasonable. In your case, if your client is actually your company's client, then you will be in violation of your employment agreement. If your client is not your company's client, then you may be able to do it. The content and wording of your offer letter is important.
