Non clearance of 7 months salary

I worked for a start-up based in Aligarh and having their office in Noida for 10 months. Of this my 7 months salary is still pending. I got 60% of my salary for 3 months and the rest 4 months a single penny was not given but only assurance of payment was given. I resigned still they gave assurance. Then they closed the Noida office, I communicated through mails and got assurance everytime. Now its been 3 months since I resigned but all they give is assurance (1 month ago) and do not receive call or reply to emails. What should I do next?

Hi,
As for as your salary is concerned you may recover the whole due salary by sending them a legal notice through your Advocate/Counsel. After getting Legal notice they may deem fit to pay your due salary.

Dear Client,
As per your query your salary is due. It is advised to send a legal notice to the start up office for payment of unpaid salary and other dues. Thereafter you can approach labour commissioner for the same. If the start up has been wound up then there is an other legal procedure to be adopted. serve a legal notice to the employer for payment of the arrears of your salary within 30days from receipt of the notice. if the employer do not pay the arrears even after receiving of the notice then file a case SUIT FOR RECOVERY OF ARREARS OF SALARY in civil court off your area.
