No claim on death of labor. Is there need to deposit compensation?

15-Oct-2023 (In Labour & Service Law)

Is it compulsory to deposit the death compensation amount of deceased by employer with labour commissioner even when the death compensation claim is under progress by the insurance company and no suit of delay is filed by the next of kin of deceased? Since the cheque of death claim will be handed over to the NOK of deceased directly by the insurance company through Labour commissioner, what is the safe guard for return of the money to me i.e. employer, even if it is deposited with the Labour Commissioner in anticipation till finalisation of the case by insurance company?

Yes.. In many cases and contracts Insurance company is not liable for penalty and interest.

So, if employer wants to keep his self safe. its need to deposit whatever amount he is agree.

Its described in provision in workmen compensation act 1923.
