Need advice regarding promotion

some one made sec 138 N. I Act case against me which is pending before court. concern person has intimated the matter to my office. Office has issued memo and asked about the matter. I replied that the case is base less and pending before court. Now office refused to give my macp. I m a central government employee. Question is can office refuce to give my macp as per rule. Kindly help me. Thank you.
That depends on the rules of your department. It is necessary to know the rules that you are mentioning before answering your question. If there is a provision in the rules regarding the same then department can refuse macp. However it differs from case to case.
