15-Jun-2023 (In Labour & Service Law)
I am working with one consulting farm. We have taken Skill Development Program to train 7000 number of candidates. The project cost is near about 1.4 cr. Because of Aadhar card, bank detail and other few issues of trainee candidates near about 60 Lakh is still pending with the National Skill Dev. Corporation. Now giving the pending amount reason organization cut down my total one month salary Rs. 80000/- as a penal action. I know that I have done my job honestly, but Its Govt program we don’t do much with it. Management is cutting down 5% salary as a saving fund, since 3.9 years I am working in organization near about 2.5 lakh is my saving with organization. But they want to grab that money also on the name of penalization. Please guide what I have to do?

Hi,
Organisation without conducting a fair hearing or departmental inquiry has no right to cut down one month salary, more so further cutting by 5%. Penal Action requires a concrete reason and proof for same. Having said that, if you have done your job honestly you should get a reasonable chance to explain yourself. After that only any action can be taken. You can file a case against company on the grounds they are denying you open, fair and reasonable hearing.
