Multiple membership in the same Board constituted under the Water Act

Hi . The Government of Karnataka has nominated Secretary, Dept. of Ecology and Environment as Board member under Section 4(2)(b) of the Water Act & he is still continuing as member. The Government has again nominated the same Secretary as Chairman (member) under Section 5(6) of the Water Act, 1974 for the causal vacancy created during resignation of earlier nominated chairman for the balance period. Is it legally acceptable . Is it not amounts to disqualification under Section 6(f) of the Water Act as " he is salaried office with the government constituting the Board" P. clarify the doubt

Section 6(f) of the water Act 1974 says that  is a director or a secretary, manager or other salaried officer or employee of any company or firm having any contract with the Board, or with the Government constituting the Board, or with a local authority in the State, or with a company or corporation owned, controlled or managed by the Government, for the carrying out of sewerage schemes or for the installation of plants for the treatment of sewage or trade effluents, if and so if the Chairman falls under this section then yes disqualification can be done.
