maternity leave related issue

13-Apr-2023 (In Labour & Service Law)
Sir, I am a contractual employee of NIELIT working as Senior Technical assistant. According to clarification from ministry of labour and employment -http://www.labour.nic.in/sites/default/files/The Maternity Benefit (Amendment) Act,2017 -Clarifications.pdf it is clear that contractual employees are equally eligible for maternity benefits. But in my case, my employment contract of two years ends on 8th december, 2017 which might be extended as on contract. My maternity leave will start from 5th august 2017 to 5th february 2018. that is my contract will end before maternity leave ends. In that case will I get 6 month maternity leave on just till the date of my contract date.

You can avail the maternity benefits until the term of your employment continues, after that as your contract may be renewed then you can continue to use the maternity leave benefits from there on i.e, 26 weeks.
