Legal validity of the Service agreement

Respected lawyers Is the service agreement for educational institue signed is legally valid? Six months notice period and five years lock in is mentioned in agreement. The employee signed the agreement in pune when it is mentioned as mumbai in agreement. Only employee signed but employer did not sign in same city. No copy is given to employee
. Is such agreement not signed in each presence valid? Will it stand In court? Company has taken six months salary cheque which is undated as a security cheque. Are security cheques come Under 138NI? What can I don to avoid 138 NI case is it is maintainable? Please guide.

1) have you mentioned signing place as Pune?

2) the agreement is not valid, you have to act accordingly constitution Article human rights to live.

3) If you have given cross cheque signed to institution. If they deposit in bank and the cheque got bounce than you will be in trouble.

The agreement is valid and binding. One has to go through every line of the agreement to precisely answer your point.

Also any cheque which has been issued comes under the ambit of sec.138 of NI Act.
