Legal action when one doe snot get Paternal leave

I am working with a pvt. ltd. Company . Last month I have applied for 5 days paternal leaves, but I did not get paternal leave benifits and has been approved my leaves as LWP (leave without pay). Please advise me what should I do?

yes it is absolutely true that a father also has equal responsibility towards the child like a mother and paternity benefits would help a couple to raise their child together as majority are now nuclear families. In this term the state government in West Bengal is already providing paternity leave for 30 days. But it is depending on the company policy that how many days of paternity leave is given by that company. There are some of the companies that are father-friendly. They are as follows:
Facebook India: 16 weeks, Cisco Systems India: 12 weeks, Google India, Star India: 4 weeks, Syntel, Kotak Mahindra Bank, Microsoft India, Hindustan Unilever Limited, GSK Consumer Healthcare: 2 weeks, Flipkart, Godrej, Intel India, Asian Paints, PayPal: 10 days, NIIT, Accenture: 1 week, Infosys, PWC India: 5 days paternity leave.
But they are not legally bound. Its depend on their moral.

Try resolving the issue by having a discussion with the HR. Submit them the relevant documents before them justifying your paternity leave. Incase things do not get sorted, send the co. a legal notice asking that to take remedial measures forthwith.
