Legal action against employer not providing the pending salaries

I joined a organization on 1st March 2018. On 21st May 2018 got a reason of non performance and ask to leave by my employer. I asked for my salary of April and May in the answer they are giving me the schedule of 3 months or more to pay my dues. Also not ready to send a termination mail from my services. After asking the reason said it's come under Misconducts ( no performance is a misconduct from their side) kindly guide what to do in such circumstances.

Dear Client,

The matter is non performance and before the termination the employer has to give a show cause notice or warning letter to improve your performance.
