Job left due to Management Harrasment
11-Apr-2023 (In Labour & Service Law)
Hi, I am Vipin Kumar. I got selected for non voice process. I worked more than 5 years in a BPO, Noida, fixed shift & offs. One day, I was told that I was being transferred into a voice process on the basis of random selection. They didnot give me any written confirmation on paper or e-mail which declines High Court decision. Therefore, I had to leave my job because voice process has rotation shift not the fixed shift. My question are: 1. Can any management move any employee into any process without any reason? Since I joined the company my Basic Salary was Rs.48000.00(annually). Therefore, My PF amount was Rs.480.00 per month from my side and It was same for 5 years. They increased my salary every year but not the basic salary. When I left my company, I got only amount of Rs.69000.00(approx) for 5 years. It is company's benefit and the employee's loss. 2. Is basic salary increment company decision or government decision? or Is it mandate to increase basic salary every year?
The employer can transfer any employee to any process but providing prior notice and consent of the employee. As your salary was increased per year keeping the base salary same, the employer has not violated any rules regarding to the hike in salary. Though, as the employer has not provided you with any prior notice or in writing you are free not to join in the said process. Also, it depends upon your employment contract which is required to be looked into.
