Is Notice period valid if salary due for 2 months

18-Nov-2024 (In Labour & Service Law)
I joined a small Pune based company on 23-Sep. But the employer has paid less than half of the salary for the month of Oct. 2024 and verbally stated that the rest of the salary will be paid by the end of the month, which i doubt. I have already decided to quit the company. In a situation of harrassment, am I bound to serve the notice period

Well, you are not at all liable to serve the Notice Period, if they have not been following terms and conditions of the Employment Contract executed with you, then, you are also not liable at all to honour such terms and conditions, which are favoring them. Serving of Notice Period is one of such condition which is favoring them, and without receiving Salary, if you serve Notice Period, it won't favor you, so choice is your's - What you want to do! For your kind info, I am always available to protect you legally.

In the situation of Harrasment, you are not bound to serve the Notice Period at all. If the Employer has not been paying you due share of Salary without justifying the reasons for the same, then what can be done! You are right to quit from the Company.
