Improper termination from service as Network Specialist in MNC

22-Sep-2023 (In Labour & Service Law)
I worked as Network Specialist in a well known mnc. I was first put in pip ,the reason given that I was a unbillable resource for a long time and have become billable just 3 months back. This happened during March when annual appraisal ratings are given. My manager then set some goals that I had to wok upon during pip in the tool.During the pip period I was mostly in night shift and had very little interaction with my manager. After the pip period of evaluation which is around 2 months ended I went to office one fine Monday ,their the Hr called me after which the AVP of my account came.He told me that my performance during the pip period was unsatisfactory and as a result they were firing me.When I told them to show some kind of stacks or scorecard for the period they did not show me any data .I dont think my performance was bad and they have wrongfully fired me.It is to be noted that during the pip period my manager did not discuss at any time about my performance.

If you have already been ousted then send them a legal notice asking for your full and final settlement and for your valid approval of exit so that you can gracefully join some new company. In case, they refuse to do so or say do not respond back to your notice then you may come up before the competent court of jurisdiction without any hesitation asking for a heavy sum in against them for the defamation and mental harassment done by them.
Or if you are still with the company you can ask for domestic enquiry over there itself in the company premise and can have a fair trial of your performance evaluation.
All the best for your future.

According to the Principle of Natural Justice, your employer should have given you full opportunity of fair hearing before your termination from service as Network specialist. From the plain reading of your query it is crystal clear that your employer did not raise the issue of your alleged unsatisfactory performance and was not transparent in handling with you. Pease give me the full account of your case in my email so as to enable me to guide you properly.

You are at liberty to file a suit against the employer for illegal termination of service. You must approach a lawyer with details including your appointment letter. The final opinion is possible after studying the terms of employment.
