Illegally terminated by a college as lecturer what can i do

20-Apr-2023 (In Labour & Service Law)
I am a Hindu from general category. My qualification is MSc BEd and KSET. I was appointed as part time lecturer in Biology department in a science college which is semi private institute for teaching. First time appointment letter was given for six months. Thereafter my services were extended verbally after taking my interview every year. I served continuously for 3 years from June 2012 to May 2015 and suddenly I was told not to come to college wef next academic year starting June 2015. No termination letter is given. Lower court and Bangalore High court bench at Dharwad dismissed my case on ground that no termination letter made available. What is the legal remedy available? It is the standard practice of the institute that they never give anything in writing it is all verbal. But all salary is paid through bank I have details. Attendance register is maintained by the college. What can I do Sir, please advise.

As there was no appointment letter given to you after 6 months also, no termination letter was provided to you the said case was dismissed. However, you can file a complaint in the labour court seeking the same relief. reinstatement is unlikely to be awarded though, you can claim compensation for the same. You will have to provide all the documents supporting your claim.

You just check out whether college got any bye-law or circular which states about any rules and regulations applicable to the part time lecturer's if it is so you have to collect it and contact your advocate. If you were told verbally to leave you would have sent legal notice through registered post to the concerned person who has told you to leave by asking the reasons, after seeing his reply you could have gone to the court as you don't have termination letter. Now as you are stating that your case is dismissed in High Court also I think you are not properly guided perhaps the approach might be wrong, consult some good advocates at your place by taking your case documents.
