Illegal termination of Store manager and deducting the payable salary

Sir, My Cousin was working as a Store manager in an reputed Restaurant. Last month there was an E-voucher issue all over india. As his store was one which is also involved in the issue he and his 2 shift managers were restrained to go to the office. On frequent calls to the higher official there was no response. Later namesake enquiry was held. Prior to enquiry his higher official have threatened and got a letter from him stating that he will be responsible for the money in issue. But in rest of the country store managers were allowed to go for the job on paying the issue amount. The enquiry result were also not revealed for more than 10 days. Frustrated on the same when my cousin approached regional HR through an mail they too donot response. When he asked with the higher official of his store they said that he has been terminated. He has just received an termination letter from head office stating that he has indulged company money.His salary of Rs.1 lakh is also held back by Co.

Your Cousin is drawing salary of Rs.1L and his designation is Store Manager. Therefore, he is not a Labour as defined under Labour laws. Hence he can approach civil court by filing money suit for recovery of money and to submit a representation to Top Management with a copy to Labour Commissioner and Police Station for the injustice made to him.
