I worked for 8 years 9 months for a company. Will i get gratuity?

Dear Sir/Madam, I am working with a Group since 19th May'2008, I joined on 19th May in their ABC Company (actual name is not written here) they transferred me on 1st Nov' 2012 to their other XYZ Company but I did not resign from ABC Company nor they provided any transferred letter from ABC to XYZ. Now its Feb'2017 and I want to resign as I have got a job with other employer. So my question is that will be I be liable for Gratuity if I leave the present company as I have worked in continuation with this Group since May'2008 to till Date (8 years 9 months approx.). If company does not give me payment of Gratuity, can I get it legally? Will my case stand? Please advice. as I will loose huge amount of Gratuity because of employer's unethical practice. Every employer is bound to give gratuity amount to its employees if it employs more than 10 people. The gratuity is given after leaving the job of you have completed continuous service of 5 years. Gratuity is a non taxable amount provided employer gives gratuity according to the formula.

As u know clearly if an employee completes 5 years in any organisation, he is eligible for gratuity. Now u have to clarify ur case then only we can find out remedy.
