24-Mar-2023 (In Labour & Service Law)
I am an employee in BSNL. My wife was an employee of Dept. of Posts . She expired last year due to cancer. I am getting her family pension. . Now I want to remarry. I am having two sons ; one 20 years old and another 17.5 years old. Once I marry family pension of my wife to me will stop. I know it. My question is ....Whether my wife's family pension will be paid to my sons till they turn 25 years ? I have read may books and searched websites. I am in a state of confusion. Please clarify and if possible provide the order number reference/ link.

As you are going to remarry and thus according to the rules, husband is not entitled for family pension. If the minor child is alive, the family pension could be paid through the father as guardians of the child subject to the recognition of his legal guardianship.
