06-Sep-2023 (In Labour & Service Law)
Dear Sir good morning, Sir I am a marketing professional, I am worked four years in my past company, 45 days back I am resigned my job and clear all my accounts, they gave me the relieving letter and experience letter. Then I am joined in another competitor company. My past company hold my cheques and salary. Please give me a advice how to take my cheques.
Hi
If the company is holding your cheques, you should issue stop payment to your bank.
If the company is withholding your salary that too after 1 month from the date of you being relieved, you may issue a legal notice and file a case in the labour court( if the amount is less than 1 Lakh) or civil court(if the amount is greater than 1Lakh)
