how to sue the hospital for medical negligence

My sister in law contacted swine flu from patients while working in the hospital as a radiology technician. The hospital did not give her any medicines, nor allowed her any paid leave. She earns 8000 Rs per month. But they are giving her days off without pay and no compensation, nor any free medicines. Is there a way to sue this hospital?
