How to recover dues for work from home job profile

12-Apr-2023 (In Labour & Service Law)
I am a finance professional working as confirmed employee with a private limited company since June’14, back in start of sept’16 I met with a bike accident causing multiple fractures, forcing me to stay at home as per medical advise for 2 months. I had informed my company and mailed them all reports and doctor’s case papers, during the above period I was working from home as communicated to my reporting manager on mail & whatsapp. However, I was only paid only for 7 days, out of the total 50 days work from home. I had submitted each and every details of the work done to my manager. He kept on delaying balance payment assuring to decide and pay shortly. Because of the above and no appraisal being conducted I tendered my resignation in mid-March’17 with 2 months, notice period to be served. Kindly let me know if there is any way I can recovery the balance pay for work for home done by me.

Before advising you we would like to go through the HR policy and your employment agreement.

Basically the procedure for recovery of your full and final settlement is that,

Initially you should send a legal notice to the company through and advocate asking for your full and final settlement be done.

Thereafter, if the company doesn’t respond to the same then you can file a suit for the recovery of your dues in the concerned civil court.
