How to file a claim for Pension by family of deceased

Mere office main ek public servant me suicide kr . Uske death me baad milanewali 18 lakh ₹ cash or daily pension 20000 ₹ milegi.. lekin o servant to death hai usane uske service book main uske wife son douther kisi ka nomination nhi kiya hai . Nomination uske Bhai mother brother father ke naam hai. Aab is family me court main Bombay regulations act 1827 under sec. 3 case pending uske department ke koi log unka emotionaly claim kr rahe hai . Is claim ke bajese govt ka money loss hoga . Or unka nomination nhi rahkar bhi unko claim mil rahe hai ab case ka result pending hai . Us family ka erada hai ki judgement order ke pahile hi claim karna . To sir main ye govt or unke family ke miswork ko kaise rok sakta hu..... Aaisa boora zhoota work rokane keliye ka karna padega ?

You will have to give a word to the concerned department also, you can file a petition claiming injunction on the claim as well. However, there is no alternative way as according to the section 3 of the said act, court upon a condition when there is no claim, then the court upon being satisfied upon the request of the claimant, will grant the certificate to him, and will recognize that person a legal heir. Also, even though the deceased person did not nominate his wife and children, they are eligible for claiming the same as they are his dependants under the purview of provisions of Hindu Adoptions and Maintenance Act (1956).
