How to deal with pendency of false case?

I have selected for Central Excise department last year due to pendency of criminal case (498A,323,504,506,IPC AND 3/4 DP ACT) against me department withheld my joining ... I am really depressed how can i get my joining? Actually this case registered against my brother they also included my name ...
File civil writ before honble high court for quashing of impugned order of termination passed against you. However in civil writ you need to disclose the content of the first information report lodged against you

As long as you disclosed the factum of pendency of this criminal case at the time of applying for this particular job, the government cannot withhold your joining. Mere pendency of a criminal case is not a bar to appointment or promotion. However, if a govt. employee who is arrested in a criminal case and not released within 48 hours, he can suspended from service and disciplinary proceedings may be initiated against him. Approach the High Court by way of filing a writ of mandamus and seek appropriate relief.
